RELEASE OF LIABILITY, INDEMNITY, AND ASSUMPTION OF RISK
READ BEFORE SIGNING
Location: 4805 Musson Rd, Howell, MI 48855
AGREEMENT
In consideration of being permitted to enter and participate in any activities at the property located at 4805 Musson Rd, Howell, MI 48855 (the “Property”), including but not limited to strolling the gardens and greenhouse, being around insects and pollinators, picking flowers, designing and wearing floral arrangements, taking photographs, attending events, and using any recreational or play areas, I acknowledge and agree to the following:
ASSUMPTION OF RISK
I fully understand and acknowledge that:
(a) Risks and dangers exist in entering and using the Property;
(b) Participation in activities, including but not limited to gardening, photography sessions, floral design, and general use of the premises, may result in injury or illness, including but not limited to allergic reactions (plants, pollen, insects), bodily injury, disease, strains, fractures, paralysis, heat-related illness, heart attack, or death;
(c) These risks may arise from the negligence of the property owners, employees, contractors, agents, other participants, environmental conditions, equipment, or natural causes;
(d) These risks may be foreseeable or unforeseeable; and
(e) I voluntarily assume all such risks and accept full responsibility for any loss, injury, damage, or expense that I may sustain.
RELEASE AND WAIVER
I, on behalf of myself, my personal representatives, heirs, and assigns, hereby voluntarily agree to release, waive, discharge, hold harmless, defend, and indemnify the property owners, operators, and affiliates of 4805 Musson Rd, Howell, MI 48855, including their members, managers, officers, employees, agents, and contractors (collectively, the “Released Parties”), from any and all claims, demands, actions, or causes of action for bodily injury, property damage, illness (including communicable diseases), wrongful death, or other loss arising out of or related to my presence on the Property.
This includes claims arising from the negligence or other conduct of the Released Parties to the fullest extent permitted by law.
PROPERTY USE & RESPONSIBILITY
I agree to:
Act responsibly and follow all posted or communicated rules.
Supervise any minors in my care at all times.
Use all equipment, tools, and spaces safely and as intended.
Be responsible for any damage caused by myself or those in my party.
PHOTO & ACTIVITY ACKNOWLEDGMENT
I understand that the Property is an active agricultural and recreational environment that may include uneven ground, tools, water sources, structures, insects, and varying weather conditions.
TERM
This Waiver and Release shall remain valid for all visits and activities through December 30, 2026, unless revoked in writing.
ACKNOWLEDGMENT
I HAVE READ THIS RELEASE OF LIABILITY AND ASSUMPTION OF RISK AGREEMENT, FULLY UNDERSTAND ITS TERMS, AND SIGN IT FREELY AND VOLUNTARILY. I UNDERSTAND THAT I AM GIVING UP SUBSTANTIAL LEGAL RIGHTS.
